Eden contracts with Waste Management

EDEN — After several conversations, the Eden Town Board has announced a new one-year contract with Waste Management of New York LLC.

The contract calls for the collection, hauling and disposal of mixed municipal solid waste and specified items and materials, as well as the collection, hauling and processing of recyclables. This is the first of the town’s three options to renew its contract with Waste Management, for up to three additional one-year terms, following its current three-year contract, which expires Dec. 31, 2014.

In addition to continuing its current relationship with Waste Management of NY, the town approved a contract amendment, replacing the first full paragraph of Page 11 of the Original Bid Document with two new paragraphs; a change that will take effect along with the contract on Jan. 1, 2015.

The new language reads: “The contractor shall supply the town with a separate quarterly itemized report, listing the weights of municipal solid wastes and recyclables hauled and disposed of at their respective solid waste management facility of MRF, during the previous quarter. The list shall include, but not be limited to, ferrous metal cans, non-ferrous cans, clear glass, brown glass, green glass, plastic containers, newspapers, magazines, corrugated cardboard and white goods and must be filed with the town by the 15th day of the month, following each quarter. At its discretion, the town shall have the right to audit the contractor’s records to verify the accuracy of the periodic reports given to the town.”

The amendment continues, “In addition, by the 15th day of the month, the contractor will reimburse the town for all recyclable materials collected, based on a blended value formula, which is commodity-based and market-driven. The town shall receive a 50 percent share of revenue that is realized after the contractor applies and deducts their $67 per ton processing costs, provided that the floor rebate or pricing shall not be a negative value, for example, if the blended market value goes below the $67 per ton processing cost, the town would not be required to pay the contractor for its recyclables. There would be no rebate or charge for that month.”

The new contract commences Jan. 1, 2015, following the current contract.
