The Woods at Grey Cliff subdivision in Evans gets the green light

EVANS — A new major subdivision that calls for the construction of 57 new homes in the town of Evans is moving on to the next step, as the Evans Town Board has granted preliminary plat approval for the Woods at Grey Cliff.

The new development consists of 57 single-family dwelling homes located on approximately 30.5 acres on the west side of South Creek Road, 202 feet from the intersection of Old Lake Shore Road and on the north side of Erie Road, 1,120 feet from the intersection of South Creek Road in Derby.

“The planning board held a public meeting at the end of October, and we did recommend to approve this subdivision to the town board for various reasons: four of them,” said Sandra Brant, the director of planning. “We have also placed five conditions on this, as well.”

The planning board said that it voted to approve this plan because the project meets all the zoning and subdivision requirements of the town and is fully consistent with the town’s comprehensive plan; the project appears to be compatible with the character of the surrounding area; it was redesigned from the initial submittal and the new design minimized environmental concerns. The project will preserve and/or mitigate 5.1 acres of wetlands.

Conditions placed on the approval include the stipulations that final drainage plans, calculations and utility plans will be approved by the town engineer for compliance with the town requirements, including storm water regulations, and that all paving, utilities, landscaping, lighting and other improvements shall be undertaken in accordance with town stipulations and the requirements of Erie County Water Authority, Erie County Sewer District No. 2, Erie County Department of Public Works – Division of Highways and the New York State Department of Transportation.

Applicants must obtain all applicable approvals or permits and must comply with wetland regulations, in accordance with the Department of the Army Corps of Engineers. The applicant must obtain a State Pollutant Discharge Elimination System Permit. The pond must meet these requirements to control storm water run-off (drainage). And finally, this project and subdivision remain subject to final plat approval, according to Brant.

“There are approximately four acres of wetlands on the site,” she said, adding, “They are preserving 3.7 acres of those wetlands and disturbing approximately half an acre and mitigating everything on site and they are mitigating more than they are losing. The end result is that we are adding more than we are losing. These are all federal wetlands.”

Brant explained that there will also be a small berm at the site, which will minimize headlight glare, for some houses.

The homes will be from 1,400 – 2,500 square feet and are priced from $190,000 – $270,000.

The project will have two phases: Phase one will feature 25 lots and the construction of a small retention pond, and phase two is made up of 32 lots.

“Once we are finished with preliminary plat approval and the decisions have all been made, we will move next to final plat, which is where all of the details, all of the technical questions are worked out with the involved agencies and town departments and engineers to ensure proper engineering of the development,” Brant said.

“We feel that this is optimized plan to capture the most lots, but also maximize the usage of the infrastructure,” Rob Klavoon of Wendel Duscherer said.

Supervisor Keith Dash said that he is relieved that the project has undergone some positive changes and offered some reassurance to the new subdivision’s surrounding residents.

“I know there were some concerns with some of the residents and I was glad to see the developer did hire a different engineer,” Dash said.

“I also wanted to comment that the concerns with drainage are something that is at the forefront of this town board. We are very aware that, in the past, there have been subdivisions and things that have been done that have impacted the existing residents. I’ve said it before that we do not intend to hold any current resident hostage or give them any other issues or problems with their property or life in the name of advancement or development.”

In other board news:

– The supervisor was authorized to sign an agreement with the Erie County Town Highway Superintendents, to participate in the inter-municipal highway shared services agreement, effective Jan. 1, 2014 – Dec. 31, 2018.

– A public hearing to discuss proposed local law No. 9, to amend and/or add to the town code chapter 144 “Peddling and Soliciting and Chapter 10 Fees” was scheduled for 7:10 p.m. on Jan. 8.

– A tax anticipation note in an amount not to exceed $1.2 million was approved. The TAN was issued in anticipation of the collection of real estate taxes or assessments to be levied in the fiscal year ending Dec. 31.

– Proposed local law No. 8 was adopted as Local Law No. 8 of the year 2013, setting the speed limit on Holland Road, from Erie Road to Hardpan Road, at 30 mph.

The Evans Town Board will next meet for its annual organizational meeting on Jan. 8.
