The former Blockbuster Video , 266 Buffalo St., Village of Hamburg, is getting an overhaul, as it is being converted into a Bikram yoga studio.
The grand opening of Bikram Yoga Studio, 266 Buffalo St., is now scheduled for Monday, Sept. 24.
Paperwork for a landscape plan was not submitted by Friday, Sept. 21, which was when the original opening of the yoga studio was scheduled.
Business owner Gina Barrett was told Monday (Sept. 17) at the Hamburg Village Board meeting, that she will be granted a temporary certificate of occupation, so she can open, if she gets a landscape plan into the Hamburg Building Department sooner than later.
You are still lacking site plan approval, said Hamburg Supervising Code Enforcement Officer Kurt Allen. You need to submit a landscaping plan and nothing has been done about this and now we are down to the 11th-hour.
Allen told Barrett they are trying to work with her to help her get this opened.
Weve violated our own rules and regulations to grant you the courtesy to continue to building without an approved site plan, Allen said.
Barrett said she was confused about the process with the village and thought that everything was under control.
I always come to these meetings thinking that what we are submitting is acceptable. Then I come away shaking my head because there is a lot of mis-information and mis-communication, Barrett said.
I was unaware that the site plan was still an issue until last week, Barrett said.
According to Barrett, difficulties and delays with getting permits and getting this project started caused her to lose her investors and she had to put the project on hold for a few months.
I dont know what you want, Barrett said.
You knew there were problems, they were raised at the December and January meetings, said Village Attorney Edward J. Murphy. The landscaping plan needs to be submitted to Kurt and Jeff (Adrian) because they have the expertise to know what will be acceptable,
We want to work with you and again, we are breaking our own rules to let you have a temporary CO without an approved site plan, said Allen.
The board agreed that even if she has a temporary CO, it will be pulled if a proper site plan is not submitted and approved.
That is the only leverage we have, said Mayor Thomas Moses.
Get us those landscape plans as soon as possible, Allen said.
In other action, the board:
Will hold a public hearing at 7:15 p.m. on Monday, Oct. 1 on the proposed code revisions on animals and fowl in the village.
Heard Village Administrator Donald Witkowski report that Tzetzo Construction is continuing work on 12 Main St. (old Kronenberg Building) and that drawings have been submitted for a small park/green space for half the space on the corner of S. Buffalo and Main streets by the building. The drawings show a low wall, about 3-feet in height, with lamps on top. There will also be landscaping and plantings.
The other half of the space will be for public parking, Witkowski said.
Heard from Public Works Superintendent Marc Shuttleworth the large paving projects are finished for the season and that just spot patches are being done.
Prospect Avenue was not done because the utility trucks are on the street changing out poles and tearing up the road. Plus it is a main school bus route. It will be evaluated next season, Shuttleworth said.
The board next meets on Monday, Oct. 1 in a public work session at 5:30 p.m. followed by a regular meeting at 7 p.m.
