Disturbance at restaurant leads to charges

Village of Hamburg Police were called to John & Mary's at about 8:30 p.m. on Sunday, May 4 for a disturbance inside the business.

According to police, Eric Telaak, 39, Hamburg, was creating a disturbance inside the business and wound up over the counter damaging the restaurant's computerized cash register.

Telaak then ran out one of the doors and was apprehended by Village of Hamburg Police Officer James Lichon.

Police report that Telaak was belligerent and uncooperative with them.

Telaak was charged with disorderly conduct and criminal trespass. He was released on an appearance ticket to return to court on May 7.

DWI arrests in Eden

Town of Eden Police charged three people with driving while intoxicated in less than 40 hour period last weekend.

At 2:50 a.m. on Saturday, May 3, Eden Police Officer Nicholas Blasz charged a 44-year-old Lake View man with driving while intoxicated after he was observed speeding and crossing over the center of the road on East Eden Road.

At 12:30 p.m. on Sunday, May 4, Blasz stopped a 38-year-old Hamburg woman for crossing over the center of Route 62. She was charged with DWI and she refused to submit to a Breathalyzer test.

At 6:37 p.m. on Sunday, May 4 Officer Shawn Bishop responded to a two car accident on Route 62 and Bley Road.

After investigating the scene, Ronald F. Salzman, Jr., 43, of Eden was charged with DWI.

He was transported to Lake Shore Health Care Center by Eden EMS with a minor injury, police said.
Salzman was also cited for failing to yield the right-of-way at an intersection. The occupant of the other car was not injured.

Pair charged for making graffiti at Bennett Beach

While on patrol Tuesday, April 29, Evans Police Officer Ralph Maslach noticed a car parked at the locked gates of county owned Bennett Beach Park and watched as two men walking from the beach area with a spray can of paint in their hands.

Upon questioning, the two suspects admitted they had spray painted the break wall on the beach. In their possession were 20 spray cans of paint in green, yellow, reds, white, black and tan, a gallon of base paint, extra spray nozzles, rubber gloves and breathing masks.

According to Detective Lt. Ernest Masullo, the pair told Maslach they were covering up the obscene items already on the wall with their “art.”

Seth R. Graham, 20, Hamburg and Thomas J. Burns, 19, Aurora, were both charged with making graffiti and possession of graffiti instruments.

Damage to the break wall was set at $1,600 and additional charges of felony criminal mischief are now pending against the pair, who are to appear at Evans Town Court May 12.

Assisting Maslach was Officer Joseph LaRosa.

Reminders issued about occupying village parks

There are two Village of Hamburg parks where skates, skateboards, bicycling and horseplay are prohibited.

None of these activities are allowed in Centennial Park or Peace Park. Any violation of this law can result in a $100 fine.

Police also remind residents, particularly teenagers, that all village parks close at dusk.

According to Village of Hamburg Police, they have been charging people who are violating this code and future charges are pending.

“So much damage is being done to village property by these youths,” said Captain Michael Melisz.

“These are public parks for people to enjoy, not to wreck.”

DWI accident in Evans

Town of Evans Police Officer Peter Smith responded to a call of an accident at 10:16 p.m. on Monday, May 5.

Upon arrival he found a vehicle which had hit a tree head on off Revere Drive, with the driver unconscious behind the wheel and having a strong odor of alcohol coming from him.

According to police, the driver, Michael Ralph, 23, of Evans, did become semiconscious and had to be extricated from the vehicle and was transported by Rural Metro to Highland fire hall, where he was then taken by Mercy Flight to the Erie County Medical Center.

Ralph was later charged with driving while intoxicated, no seat belt and failure to keep right in a two lane road.

Florida man charged in beer theft in Derby

When Town of Evans Police Officers Brian Kauzala and Matthew Stonitsch responded to a recent larceny at Tops in Derby at 6:20 p.m. on Saturday, May 3, they were given a description of the suspect and a license plate number of his vehicle.

A computer check gave the officers the suspect’s name and address, so they went to his home to speak to him.

When Thomas P. Moran, 53, of Daytona Beach, Fla. responded to the officers query about his presence at Tops, he responded he had gone to the store to purchase clams.

When asked about a 12-pack of beer that had been reported taken, and was in sight of the officers, Moran allegedly attempted to kick it between the refrigerator and a kitchen cabinet and said “What beer? I don’t know,” police said.

Moran was transported back to Tops, where he was identified by the store manager and was consequently charged with petit larceny.

Timmerman sentenced

Ronald Timmerman, 30, of Hamburg, was sentenced May 5 to 90 days in jail after he admitted contempt of court for three violations of a prior order banning him from operating in the home improvement business, said Attorney General Andrew Cuomo.

According to Cuomo, on Jan. 26, 2007 his office obtained a court order prohibiting Timmerman from operating a home improvement business after an investigation found he repeatedly failed to complete work after requiring advance payments from consumers.

Timmerman was banned from operating as a home improvement contractor unless he paid $30,000 in restitution to consumers he defrauded.

Within a few weeks of the court order, the Attorney General’s office discovered Timmerman was soliciting and providing home improvement services, despite not paying any restitution to consumers, which initiated the contempt of court proceedings.

According to Cuomo’s office, on Monday Timmerman admitted in New York Supreme Court of Erie County that he had provided home improvement services to three separate homeowners in Hamburg, Alden and Cheektowaga in February and March 2007.

More graffiti at businesses

Town of Hamburg Police report that someone spray painted some graffiti on the rear of the Duffett Plumbing building, on a cube van for Southtowns Appliances and North American trailers, all located on Maelou Drive.

Man assaulted, robbed in the Town of Evans

Town of Evans Police report that an Evans man was struck in the face with a beer bottle and then robbed at about 3:30 a.m. on Thursday, May 1.

According to police the victim was given a ride home by two men from a local establishment.

Upon arriving at his house he was assaulted by the men who allegedly struck him in the face with a beer bottle, knocking out his front tooth and fracturing his left eye socket.

They then allegedly removed about $100 from his wallet.

The Evans Detective Bureau is investigating the incident.

Jesus statue recovered

On Monday, May 5 Town of Evans Police recovered a statue of Jesus, which was found in a parking lot in the Village of Angola.
